Abstract/Description |
The testator J. C. Williamson bequeathed his race horses to his trustees upon trust to sell the same as soon as conveniently might be after his death and to pay and divide the proceeds among certain charities. He devised and bequeathed his residuary real and personal estate to his trustees upon trust to sell, and out of the proceeds of conversion to pay his funeral and testamentary expenses and debts, and subject thereto for certain beneficiaries. The same persons were appointed executors and trustees of the will. The race horses were sold by the executors before they obtained probate. Held, that the expenses of the sale of the horses and of their care and upkeep prior to the sale must he borne by the specific legatees. |
