Abstract/Description |
The plaintiff sued the defendant for damages for false representations whereby he was led to underwrite and subscribe for shares, which became valueless, in a company formed to engage in theatrical enterprises. Held, that there was no evidence that the shares were, at the time when they were allotted to the plaintiff, worth less than he became liable to pay for them; that there was no evidence that the plaintiff suffered any loss in respect of·the shares, except by reason of a subsequent deterioration in value to which.it was of the nature of shares in such a company to be naturally and inherently prone; and, therefore, that the plaintiff had failed to establish that he had suffered any damage directly resulting from the fraud. |
